By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, do not use the Site. You must be at least 16 years old to use the Site. If you are under the age of majority in your province, territory, or country, you may only use the Site under the supervision of a parent or legal guardian who agrees to these terms on your behalf.

4. Eligibility, Geographic Scope, and Access
The Site primarily serves individuals and organizations located throughout Canada. Access from other jurisdictions is permitted where lawful. You are responsible for compliance with local laws that apply to you. 13. Limitation of Liability
To the maximum extent permitted by law, Vybe ApS and its directors, officers, employees, contractors, and educational contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business interruption arising out of or related to your use of the Site, even if advised of the possibility of such damages. In all cases, the total liability of Vybe ApS for any claims relating to the Site will be limited to the greater of: (a) the amount you paid (if any) to Vybe ApS for the specific service giving rise to the claim in the 12 months preceding the event; or (b) €100 (one hundred euros).
14. Indemnification
You agree to defend, indemnify, and hold harmless Vybe ApS and its personnel from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Site; (b) your violation of these Terms of Use; or (c) content or information you submit through the Site that infringes or violates any law or third‑party rights.
15. Force Majeure
Vybe ApS will not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including natural disasters, power failures, telecommunications outages, labor disputes, acts of government, pandemics, cyberattacks, cloud or hosting provider failures, or other events of a similar nature that make operation of the Site impracticable.
16. International Use and Consumer Rights
Vybe ApS is established in Denmark and serves participants throughout Canada. We do not represent that the Site is appropriate or available for use in every location. Access is at your own initiative and subject to local laws. If you are a consumer with mandatory rights under the laws of your place of residence (for example, provincial consumer protection rules in Canada or EU consumer rights), those rights remain unaffected by these Terms of Use to the extent they cannot be waived by contract.
17. Governing Law and Venue
These Terms of Use are governed by the laws of Denmark, without regard to its conflict of laws principles. The courts of Copenhagen, Denmark, will have exclusive jurisdiction over any dispute arising from or relating to these Terms of Use or the Site, subject to any non‑waivable rights you may have to bring claims in the courts of your home jurisdiction under applicable consumer laws. Nothing in this clause limits rights you may have that cannot be contractually limited under applicable law.
18. Dispute Resolution and Informal Process
Before initiating formal proceedings, you agree to email us a short description of the issue and desired resolution and allow 30 days for an informal attempt to resolve the matter. If we cannot resolve the dispute informally, either party may proceed consistent with the governing law and venue clause above. Each party will bear its own costs unless a tribunal orders otherwise. Class actions and representative claims are not permitted unless such a waiver is unenforceable under applicable law.
19. Termination and Suspension
Vybe ApS may suspend or terminate your access to the Site at any time if we reasonably believe you have violated these Terms of Use or your use poses a risk to the Site, other users, or our operations. Provisions that by their nature should survive termination (including ownership, disclaimers, limitations of liability, indemnification, and governing law) will continue to apply after termination.
20. Severability, No Waiver, and Assignment
If any provision of these Terms of Use is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer any rights or obligations under these Terms of Use without our prior written consent. Vybe ApS may assign its rights and obligations in connection with a merger, acquisition, corporate reorganization, or sale of assets.
21. Entire Agreement and Electronic Communications
These Terms of Use, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Vybe ApS regarding the Site. You agree that electronic communications, disclosures, and notices satisfy legal requirements for written communications to the fullest extent permitted by applicable e‑signature laws.
